1. Acceptance

By downloading, accessing, or using Bemaxx, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the app.

2. Eligibility

Bemaxx is intended only for users aged 17 and older. By using the app you represent that you are at least 17 years old and able to enter into these Terms. Bemaxx is not for children.

3. What Bemaxx is

Bemaxx analyzes photos you submit using artificial intelligence to give you cosmetic-feature estimates (scores and bands) and a personalized self-improvement protocol covering habits such as skincare, grooming, sleep, posture, and training.

Bemaxx is a coaching and entertainment product. It is not a beauty authority, a measure of your worth, or a substitute for professional advice.

4. Not medical or professional advice

Bemaxx does not provide medical, dental, dermatological, nutritional, psychological, or other professional advice, diagnosis, or treatment. Its scores and protocols are general self-improvement suggestions, not health assessments.

Always consult a qualified professional before making health, dietary, or training changes. If your use of the app or focus on appearance causes distress, please seek support from a qualified professional. Do not disregard professional advice because of anything in Bemaxx.

5. Your content and the license you grant

You retain ownership of the photos and content you submit. You are responsible for what you upload.

You grant Bemaxx a limited, revocable license to process your photos solely to provide the service — to analyze them, generate your results, and store your scans so you can track progress. We do not use your photos to train or improve our models unless you explicitly opt in (this setting is off by default).

You can revoke this license at any time by deleting a scan, deleting all scans, or deleting your account. Deletion is permanent.

6. Acceptable use

You agree to upload only photos of yourself, or photos you have the explicit right and consent to submit. Do not upload photos of other people without their consent, photos of minors, or any unlawful, infringing, or abusive content.

You agree not to misuse the app, attempt to reverse-engineer or disrupt it, or use it to harass, harm, or evaluate others without consent. We may suspend or terminate accounts that violate these Terms.

7. Subscriptions, auto-renewal, and cancellation

Bemaxx offers auto-renewing subscriptions (such as weekly, monthly, and annual plans), and may offer a free trial. Subscriptions are sold and billed through the Apple App Store or Google Play and managed via RevenueCat.

Payment is charged to your store account at confirmation of purchase. Unless canceled, your subscription automatically renews at the then-current price, and your account is charged for renewal within 24 hours before the end of the current period.

If a free trial is offered, any unused portion is forfeited when you purchase a subscription. You can manage or cancel your subscription, and turn off auto-renewal, in your App Store or Google Play account settings at any time. Refunds are handled by the app store under its policies; we generally cannot issue refunds directly.

8. AI estimates and no guarantees

Scores, bands, your "potential ceiling," and protocol recommendations are AI-generated, modeled estimates. They are inherently approximate, may vary between scans, and are not promises of any outcome.

Results depend on many factors outside our control, including your own effort and genetics. We do not guarantee any specific improvement, score change, or result.

9. Intellectual property

The app, its design, content, and software (excluding your own content) are owned by Bemaxx or its licensors and are protected by law. We grant you a personal, non-transferable, non-exclusive license to use the app for its intended purpose. You may not copy, resell, or exploit any part of the app without permission.

10. Disclaimers

The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or that estimates will be accurate.

11. Limitation of liability

To the fullest extent permitted by law, Bemaxx and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the app. Where liability cannot be excluded, it is limited to the amount you paid for the app in the 12 months before the claim.

12. Termination

You may stop using Bemaxx and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect users or the service. Sections that by their nature should survive termination will survive.

13. Changes to the app and these Terms

We may update the app and these Terms over time. For material changes we will update the "last updated" date and provide notice in the app. Continued use after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of [Jurisdiction], without regard to its conflict-of-laws rules. The courts located in that jurisdiction will have exclusive jurisdiction over disputes, except where applicable law gives you the right to bring a claim elsewhere.
